Scope of the service and digital tool nature
Giventra is an online digital coordination platform operated by Digital Mind SARL (Douala, Cameroon). It provides software tools to plan celebrations, manage wishlists, coordinate gift reservations, and run Secret Santa draws. Giventra is not an event organizer, host, or venue operator.
Accounts, guest access and data backup duty
Keep login credentials and private bearer links confidential. Guests can participate without creating an account. Users are solely responsible for maintaining external backups of critical event information. While we apply standard security, Digital Mind SARL is not liable for missing, deleted, corrupted, or archived events, nor for any resulting emotional or personal disappointment.
Organizing with care, physical event disclaimer and indemnification
Digital Mind SARL has zero presence in, control over, or liability for physical events, venues, accidents, food poisoning, property damage, or guest disputes arising from gatherings planned with the app. Organizers and guests bear sole liability for their physical events. You agree to indemnify and hold harmless Digital Mind SARL from any third-party claims arising from your events, uploaded content, or unauthorized invitation entries.
Gift commitments, merchant disclaimer and payment services
Digital Mind SARL is not a retailer, merchant, or payment service provider (PSD2 / ZAG). Gift commitments communicate an intention to take care of an idea; they do not trigger orders or payments. Purchases via external links are contracts concluded solely with third-party retailers. Financial contribution links are handled entirely outside Giventra and are not tax-deductible donations.
Preserving the exchange
Follow the participation and draw rules shown for your event. Once assignments are generated, another participant’s private discovery does not reshuffle the group. Keep assignments confidential to preserve the surprise. Permitted changes depend on the event’s stage.
Limitation of liability, marketing updates and applicable law
Digital Mind SARL is liable without limitation only for intent, gross negligence, and injury to life, body, or health. For slight negligence, liability is limited to foreseeable damages for essential contractual obligations. Registered users may receive product updates regarding similar services under UWG § 7(3) with the right to opt out at any time. Governing law is the law of Cameroon, without prejudice to mandatory EU consumer protection laws (Art. 6(2) Rome I Regulation).
